Jet Finders - Terms of Use / Customer Agreement

These Terms of Use (the "Terms") govern the relationship between Jet Finders LLC ("Jet Finders," "we," "us," or "our") and each user, customer, or prospective passenger (collectively, "you," "Customer," or "Customers") who accesses our website, submits a flight request, or otherwise uses our services. Jet Finders is a lead-generation and referral service. We collect information about your desired private air travel and connect you with independent third-party aircraft charter operators and charter brokers (the "Operators") who may be able to serve your request.

Please read these Terms carefully:

Jet Finders is not an aircraft operator, air carrier, or charter broker of record for your flight. We do not own, operate, charter, control, schedule, or dispatch any aircraft, and we do not sell air transportation. Jet Finders does not accept, hold, or process payment for flights. All air travel, quoting, contracting, and payment occur solely between you and the Operator you choose to engage. Any contract for carriage is between you and that Operator and is governed exclusively by the Operator's own terms.

These Terms do not constitute a contract for carriage. Jet Finders may update these Terms from time to time. Changes are effective upon posting, except where applicable law requires notice, and will not apply retroactively to requests already matched to an Operator.

1.1 Lead-Generation and Connection Service

Jet Finders provides a technology platform and call-center service that gathers your private-charter travel needs and matches or forwards them, as leads, to one or more Operators. Our role is limited to facilitating an introduction and helping you connect with an appropriate Operator.

1.2 We Are Not the Operator or Broker of Record

Jet Finders does not provide air transportation, does not act as your agent for the purchase of air transportation, and is not a party to any charter agreement. All flights are provided by independent Operators under their own operating certificates, insurance, and terms.

1.3 No Payment Processing

Our services are provided free of charge to Customers. Jet Finders does not collect, hold, escrow, or process payment for flights or any other Operator services. You pay the Operator (or its authorized broker) directly, on the Operator's terms.

1.4 No Guarantee of Availability, Pricing, or Match

Any listings, estimates, quotes, or aircraft descriptions presented through Jet Finders are informational only, are supplied or confirmed by Operators, and do not constitute a binding offer. Jet Finders does not guarantee that an Operator will contact you, quote you, accept your booking, or provide any particular aircraft, price, or timing.

1.5 Independent Contractors

Operators are independent third parties, not employees, partners, agents, or joint venturers of Jet Finders. Jet Finders does not control and is not responsible for the acts, omissions, safety records, certifications, insurance, pricing, or conduct of any Operator.

2.1 Express Consent

By submitting a flight request or providing your telephone number or email address to Jet Finders (through our website, forms, phone, chat, or otherwise), you expressly consent to be contacted by Jet Finders and by the Operators we connect you with, at the phone number(s) and email address(es) you provide, for the purpose of responding to and fulfilling your request. This includes contact by live agent, automatic telephone dialing system, prerecorded or artificial voice message, SMS/MMS text message, and email.

2.2 Not a Condition of Service; Message Rates

Your consent to receive autodialed or prerecorded calls or texts is not a condition of any purchase. Message and data rates may apply, and message frequency varies. Jet Finders does not charge for these messages, but your mobile carrier may.

2.3 How to Opt Out

You may opt out of text messages at any time by replying STOP to any message, and you may opt out of calls or email by telling our representative or by emailing us at fly@jetfinders.com. Opting out of Jet Finders communications does not opt you out of communications from Operators you have separately engaged; you must contact those Operators directly.

2.4 Sharing With Operators

You understand and agree that, to fulfill your request, Jet Finders will share the lead information you provide (including your name, contact details, and travel request) with one or more Operators, who may then contact you directly. See our Privacy Policy for details.

• Provide accurate and complete information in your flight request; you are solely responsible for its accuracy.
• Deal directly with the Operator to review, confirm, and contract for any flight, and to verify that the Operator's quote reflects your requested itinerary before you commit.
• Comply with each Operator's rules, including arrival times, baggage limits, and travel-document requirements.
• Obtain and carry valid identification, passports, visas, and any other documents required for travel; entry into another country is not guaranteed even with valid documents.
• Comply with all applicable laws and travel requirements. Jet Finders disclaims liability for advice or information relating to travel documents, customs, or entry requirements.

You are responsible for all passengers included in your request and must ensure that each passenger is aware of and agrees to these Terms and to the applicable Operator's terms.

You agree not to:

• Use our services for any unlawful, deceptive, fraudulent, or harmful purpose.
• Submit false, misleading, or another person's information without authorization.
• Attempt to modify, reverse-engineer, scrape, overload, hack, or interfere with the security or operation of our website or systems.
• Resell, sublicense, or commercially exploit our services or any leads or listings.

Jet Finders may refuse, suspend, or terminate service to any user at any time where reasonably necessary, including for safety, legal compliance, suspected fraud, or breach of these Terms.

5.1 Services Provided "As Is"

Our services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Jet Finders does not warrant that the service will be uninterrupted, secure, or error-free, or that any Operator will meet your needs.

5.2 No Liability for Operators or Flights

Jet Finders is not responsible for, and disclaims all liability arising from, the ownership, maintenance, operation, safety, delay, cancellation, or performance of any aircraft or flight, or the acts or omissions of any Operator, broker, or other third party. All such matters are governed solely by the Operator's terms, and your sole recourse for any flight-related issue is against the Operator.

5.3 Force Majeure

Jet Finders shall not be liable for any delay or failure resulting from events beyond its reasonable control, including weather, air-traffic control, mechanical issues, crew limitations, regulatory action, labor disputes, network or communications failures, or airport constraints.

5.4 Limitation of Liability

To the maximum extent permitted by law, Jet Finders shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of use, revenue, profits, or data, arising out of or relating to your use of our services. Because our services are provided free of charge to Customers, Jet Finders's total aggregate liability to you for any and all claims, whether in contract, tort, or otherwise, shall not exceed one hundred U.S. dollars (US$100).

5.5 Application

The disclaimers and limitations in this Section 5 apply to all claims regardless of legal theory. Nothing in these Terms limits liability that cannot lawfully be limited, including for gross negligence, fraud, or willful misconduct, and nothing limits any non-waivable rights or remedies you may have under applicable consumer-protection law.

You agree to indemnify, defend, and hold harmless Jet Finders and its officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) the conduct of you or any passenger you book for; (c) your breach of these Terms; or (d) your violation of any law or the rights of any third party.

You may submit reviews, ratings, or other content ("User Content"). You grant Jet Finders a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, and display such content in connection with our services. You represent that you own or have permission to submit the User Content and that it does not violate any law or third-party right. Jet Finders may remove User Content at any time.

All technology, software, content, trademarks, and branding within our website and services are the sole property of Jet Finders or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use our services for their intended, lawful purpose. No other rights are granted.

Our website may link to or interoperate with third-party websites and services, including Operators. Jet Finders does not control and is not responsible for their content, terms, or practices.

10.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Jet Finders regarding the subject matter and supersede prior understandings.

10.2 No Waiver

A delay or failure to enforce any right does not waive it.

10.3 Assignment

You may not assign your rights under these Terms. Jet Finders may assign its rights and obligations.

10.4 Severability

If any provision is held unenforceable, the remaining provisions remain in full force.

10.5 Amendments

Jet Finders may amend these Terms by posting an updated version with a revised Effective Date.

11.1 Governing Law

These Terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules.

11.2 Jurisdiction

Subject to Section 11.3, any dispute shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.

11.3 Dispute Resolution / Arbitration

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or our services may, at Jet Finders's election, be resolved by binding individual arbitration rather than in court, and you and Jet Finders waive any right to a jury trial and to participate in a class action. This provision does not apply to claims that cannot lawfully be arbitrated.
